Terms of Purchase

Here you can read about the terms and conditions that apply when you, as a consumer, purchase goods from us via Hammargruppen.se. When you purchase goods from Hammargruppen.se, you enter into an agreement with the company Hammargruppen AB, corporate identity number 556710-7502, which we will hereinafter refer to as "Hammargruppen", "we" or "us". Hammargruppen applies both the Consumer Sales Act and the Distance Contracts and Off-Premises Contracts Act (Distance Contracts Act).

It is important to us that it is clear what terms and conditions apply to your purchase and what rights you have as a customer when you shop with us. If you have questions about the terms in this text or regarding your order in general, you are most welcome to contact us. You will find our contact details under the heading "How to contact us" below.

Order and agreement

When you complete a purchase of goods from Hammargruppen.se, you agree to these terms. When we write "Terms" in this text, we refer to these purchase terms. To purchase goods on Hammargruppen.se (or via email and phone), you must be 18 years old (of legal age). If you are under 18, you may only make purchases on Hammargruppen.se with the approval of your guardian. There may also be other legal rules that limit your right to enter into agreements with us independently. If you are subject to such rules, you need to ensure that you have permission to make the purchase.

Once you have placed an order on Hammargruppen.se, via email or phone, we will send you a written order confirmation via email. A binding purchase agreement is only entered into when you have received this order confirmation for the goods you have ordered. Your order is binding from the moment you receive your order confirmation. Therefore, it is important, if you have placed an order by mistake, that you contact us immediately. If you wish to change your order, you can only do so before it has been shipped from our warehouse. All goods remain Hammargruppen's property until Hammargruppen has received full payment.

In certain situations, we reserve the right to refuse an order or cancel your purchase. This may occur, for example, if the item you ordered is out of stock, if a product has been discontinued, or if we are unable to deliver due to other reasons (such as technical problems on the website or our suppliers being unable to fulfill their commitments to us).

Price and payment

When you shop on Hammargruppen.se, the prices displayed on the website at the time of order, as well as those stated in your order confirmation, apply. All prices for delivery within Sweden are stated in Swedish Kronor (SEK) and include Swedish value-added tax (VAT), currently 25%. Prices within the EU are shown with the applicable VAT for each respective country. For countries outside the EU, prices are shown excluding Swedish VAT, and these shipments will be subject to customs handling and import duties upon delivery.

Hammargruppen reserves the right for VAT increases, typographical errors, pricing errors, and other price changes beyond our control, and we reserve the right to adjust prices and any pricing errors. If an obvious error in pricing or product information has occurred on Hammargruppen.se, and you realized or reasonably should have realized this, the incorrect price or information will not apply. Should such a situation arise, we will contact you to inform you of the error. Any charges for shipping, cash on delivery, or invoice fees will be added and shown at checkout.

The available payment methods are displayed on Hammargruppen.se and at checkout. We accept card payments from Visa, Mastercard, and American Express. Card payments and other transactions are processed and administered via Shopify. We advise you to always read the terms and conditions for your chosen payment method carefully before completing the purchase.

If you have concerns or questions regarding the payment of your purchase, you are of course welcome to contact us, but in many cases, you will get the fastest help by contacting the payment service provider directly.

Delivery

Normal delivery time is 3-7 working days. Should deviations or delivery delays occur, we will contact you. Of course, we do everything we can to deliver your order as quickly as possible. If a significant delivery delay occurs, you as a customer have the right to cancel the purchase without cost. Hammargruppen reserves the right to decline financial compensation or reimbursement to you in such situations or for delivery delays.

Special conditions for Crowdsource: Shoes ordered via Crowdsource with a timer are delivered the season after the order is placed. For example: if the order is placed in the spring, the shoe is delivered in the autumn, and vice versa.

Shipping within Sweden: The shipping cost for orders within Sweden is 99 SEK. Orders with an order value exceeding 800 SEK are shipped free of charge. We ship our products within Sweden with Schenker, where you have the option to pick up your package at one of their agents or at your nearest post office. Available delivery methods are presented at checkout, and in some areas, specific options such as home delivery may be offered for an additional fee (even if the order value exceeds the free shipping limit).

Shipping outside Sweden: For international orders, we use UPS. The following fixed shipping costs apply:

  • Scandinavia: 300 SEK

  • Europe: 500 SEK

  • Asia, Australia & USA: 1000 SEK

Shipping companies apply their own transport conditions regarding notification, identification requirements, and storage time, and we recommend that you familiarize yourself with these at the time of purchase.

All of our packages are insured during transit and will be replaced if they go missing. If your package and/or its contents are damaged in transit when you receive it, you must immediately report the damage on site to the agent/delivery point and notify us as soon as possible.

Right of withdrawal

Hammargruppen applies the Distance Contracts Act, which means you have a 14-day right of withdrawal (return or exchange) without having to give any specific reason. The withdrawal period begins the day you or an agent receives or collects the goods (or a substantial part thereof). If you make a standard return, where the withdrawal period is also 14 days, you may need to state the reason for your return.

You generally have the right to open the packaging and try and examine the purchased goods in the same way you would in a physical store. However, the item must be returned in an unchanged condition and in its original packaging. Hammargruppen reserves the right to refuse the return, charge you, or make a deduction for depreciation if anything is missing from the return (e.g., a shoebag), or if you have used/handled the item in a way that was not necessary to examine it.

If you exercise your right of withdrawal and cancel your purchase before your order has been shipped from our warehouse, no costs will be incurred. If the package has left our warehouse or you have already picked up your package when you cancel your purchase, you are responsible for shipping and return costs, just as when you make a return.

Certain products are exempt from the right of withdrawal for health or hygiene reasons if the seal, wrapper, or labels have been broken. This applies, for example, to socks.

Important exception to the right of withdrawal: Hammargruppen offers no right of withdrawal or return for purchases of specially ordered products. This includes, for example, "Specials" from a selected manufacturer, shoes purchased via Crowdsource or Group Made to Order (GMTO), and items that have been fully modified according to your wishes (e.g., personalized embroidery, custom color or material choices). Thus, all forms of MTOs (made to order) cannot be canceled or returned. Examples of MTO orders may include, but are not limited to: orders for shoes in a different color or material than what is available in stock, attributes that can be personalized on products such as embroidery or fabric choice on Bowhill & Elliott slippers, or requested modifications in our shoe workshop at the time of purchase such as sole protectors or toe plates.

Please note that strong scents can cause health problems such as asthma or migraines. We therefore ask you to avoid strong perfumes or scents when trying on the goods you have ordered. If you cancel a purchase that included gifts or bonus products at no extra cost, these must also be included in the return, otherwise we have the right to deduct an amount corresponding to their value from your refund.

Return process: Please contact us before returning a product. You are responsible for the return shipping and its costs. Returns sent cash on delivery will not be collected. You register and create a return on our Exchange & Return page. You bear responsibility for the goods until they have been handed over to the shipping company. Refunds are made within 30 days of us receiving and approving your return (although our external payment provider usually disburses the amount within 14 days). The refund will be made to the same account and using the same method as used at the time of purchase.

Right of exchange

When exchanging within your 14-day period, you have the right to purchase a new product in exchange for each returned item. You are responsible for the return cost when making an exchange. Any price differences will be adjusted and refunded to you.

Exchange process: Please contact us before sending back the product. Returns sent cash on delivery will not be accepted. If you wish to make an exchange, the fastest way is to make a regular return of the item and then place a completely new order via the website. You can also choose to scan the QR code in the package and follow the instructions for exchange, but then the new item will only be sent after we have received your return. If you return more items than you choose to exchange for, the excess items are considered a regular repurchase, which can only be done during the period the right of withdrawal is valid.

Complaints

Hammargruppen applies the Consumer Sales Act for complaints. If an item you have purchased from us proves to be faulty (original defects present at delivery), you must notify us of the defect within a reasonable time, which means as soon as you discovered or ought to have discovered the defect. If you make a complaint within two months of discovering the defect, it is always considered to have been made within a reasonable time. You have a statutory right to complain for up to three years from the time of purchase. However, if the defect is discovered after more than two years, the burden of proof lies with you to show that the defect was original.

If you wish to make a complaint about a faulty item, you can contact us by phone +4673 820 83 77 or email info@hammargruppen.se. Remember to always fill in the return form and include it with your package. For a complaint, we may need to assess the item, and in that case, we will instruct you on how to return it to us. Normally, as a customer, you are responsible for the shipping cost to our service workshop/warehouse during the assessment period. If we approve the complaint and the defect cannot be repaired or replaced with a new equivalent product, you have the right to cancel the purchase and receive a refund via your chosen payment service provider within 14 days of approval at the latest.

Important: Do not pick up (redeem) packages that have visible damage that may have affected the condition of the item you ordered. Instead, make a complaint directly to Schenker/the shipping company at the pick-up point and ask them to send the package back to Hammargruppen with the reason written on the package.

Assortment

The range of products on Hammargruppen.se varies over time, and we reserve the right to remove items from the assortment, or make changes to the assortment at any time and without prior notice before a purchase has been completed. We cannot be held responsible for delivering sold-out or discontinued products.

Please note that product images and associated captions on Hammargruppen.se do not always accurately reflect the item's exact appearance in reality. We cannot guarantee or be held responsible for minor discrepancies regarding exact color shade, pattern matching, or similar details that may appear differently on a screen compared to reality.

Force majeure

Hammargruppen is not responsible for delays or damages caused by circumstances falling under so-called force majeure. This refers to events beyond our reasonable control, such as government actions or omissions, new or amended legislation, labor disputes, blockades, fires, floods, sabotage, major accidents, or natural disasters. Force majeure also includes political decisions or government decisions that negatively affect the market or products (e.g., sales bans, restrictions, or warning label requirements), as well as abnormal market downturns or criminal acts directed against our business that significantly affect our ability to fulfill our commitments.

Dispute

If you have complaints or comments regarding Hammargruppen's products or services, you are always welcome to contact us here (info@hammargruppen.se). Should we fail to reach a solution together and you are not satisfied with our handling, you can turn to the National Board for Consumer Disputes (ARN) via their website www.arn.se, or by post to Box 174, 101 23 Stockholm. Hammargruppen always follows ARN's official recommendations in the event of a dispute. You can also use the European Commission's online platform for cross-border complaints, which is available here: https://ec.europa.eu.

Fair Use

We have noticed that a few customers exploit returns in a way that leads to unnecessarily high environmental impact and unreasonable costs for our business. We therefore apply a "fair use" clause.

If we identify a purchasing and return behavior that deviates from the norm, we reserve the right, in individual cases, to refuse or cancel future orders, charge a return fee of 100 SEK for your returns, or block your account from future purchases with us. This may be applicable if you repeatedly return items that are not in new condition, products that do not match what we delivered, or if you buy and return an unusually large quantity of items.

We may also choose to cancel an order if there is reasonable suspicion of fraud or other criminal activity linked to the order. This may involve, for example, repeatedly unclaimed packages, unfounded claims that packages have disappeared during delivery, or if you exhibit unusual behavior in connection with picking up or returning packages.

Unclaimed Packages

If for any reason you do not pick up (redeem) your package at the agent, you must pay the costs for the actual shipping and any cash on delivery fees. Unclaimed packages will be charged a fee, invoiced afterwards, to cover our handling and return costs. In case of non-payment of this invoice, the claim will unconditionally be handed over to debt collection for further processing, no exceptions will be made.

Cookies

According to the Electronic Communications Act, all visitors to a website that uses cookies must be informed of this. When you visit Hammargruppen.se, cookies are stored on your computer. These are so-called session cookies and are used exclusively to keep track of your shopping cart and your login (if you are logged in) while you shop. Session cookies are not permanently stored on your computer but are automatically deleted as soon as you close your browser.

If you do not accept the use of cookies, you can set your browser to automatically deny cookies or to inform you each time a website requests to store a cookie. Please note that if you completely disable cookies, you will not be able to complete purchases on Hammargruppen.se, as both the shopping cart and login function require cookies to work. However, it is perfectly fine to navigate and browse the store without activated cookies.
